Article 511-3 of the French Cinema and Moving Image Code

The companies and organisations are either holders of exploitation rights or a distribution mandate for the cinematographic works that are the subject of the application and provide proof of a right of access to their material elements, or are owners of the original material elements and provide proof of an agreement from the rights holders, for at least two of the following modes of exploitation in digital form and for a duration of at least ten years:
1° Exploitation in France in cinemas;
2° Exploitation in France in the form of videograms intended for the private use of the public;
3° Exploitation in France on television services;
4° Exploitation in France on on-demand audiovisual media services;
5° Exploitation abroad.

Article 511-3

Les entreprises et organismes sont soit titulaires de droits d’exploitation ou d’un mandat de distribution des œuvres cinématographiques faisant l’objet de la demande et justifient d’un droit d’accès à leurs éléments matériels, soit propriétaires des éléments matériels d’origine et justifient d’un accord des ayants droit, pour au moins deux des modes d’exploitation suivants sous forme numérique et pour une durée d’au moins dix ans :
1° Exploitation en France en salles de spectacles cinématographiques ;
2° Exploitation en France sous forme de vidéogrammes destinés à l’usage privé du public ;
3° Exploitation en France sur des services de télévision ;
4° Exploitation en France sur des services de médias audiovisuels à la demande ;
5° Exploitation à l’étranger.
