Article 515-4 of the French Civil Code

Partners bound by a civil solidarity pact undertake to live together and to provide mutual material aid and assistance. If the partners do not agree otherwise, material assistance is proportional to their respective means.

The partners are jointly and severally liable to third parties for debts contracted by one of them for everyday needs. However, this joint and several liability does not apply to manifestly excessive expenses. Nor does it apply, unless they have been entered into with the consent of both partners, to instalment purchases or loans unless the latter relate to modest sums necessary for everyday needs and the cumulative amount of these sums, in the case of several loans, is not manifestly excessive having regard to the household’s standard of living.

Les partenaires liés par un pacte civil de solidarité s’engagent à une vie commune, ainsi qu’à une aide matérielle et une assistance réciproques. Si les partenaires n’en disposent autrement, l’aide matérielle est proportionnelle à leurs facultés respectives.

Les partenaires sont tenus solidairement à l’égard des tiers des dettes contractées par l’un d’eux pour les besoins de la vie courante. Toutefois, cette solidarité n’a pas lieu pour les dépenses manifestement excessives. Elle n’a pas lieu non plus, s’ils n’ont été conclus du consentement des deux partenaires, pour les achats à tempérament ni pour les emprunts à moins que ces derniers ne portent sur des sommes modestes nécessaires aux besoins de la vie courante et que le montant cumulé de ces sommes, en cas de pluralité d’emprunts, ne soit pas manifestement excessif eu égard au train de vie du ménage.
