Article 515-5-3 of the French Civil Code

In the absence of provisions to the contrary in the agreement, each partner is manager of the undivided property and may exercise the powers recognised by articles 1873-6 to 1873-8.

For the administration of undivided property, the partners may enter into an agreement relating to the exercise of their undivided rights under the conditions set out in articles 1873-1 to 1873-15. On pain of being unenforceable, this agreement is, on the occasion of each deed of acquisition of a property subject to land registration, published in the real estate register.

By way of derogation from article 1873-3, the joint ownership agreement is deemed to have been concluded for the duration of the civil solidarity pact. However, when the pact is dissolved, the partners may decide that it should continue to have effect. This decision is subject to the provisions of articles 1873-1 to 1873-15.

A défaut de dispositions contraires dans la convention, chaque partenaire est gérant de l’indivision et peut exercer les pouvoirs reconnus par les articles 1873-6 à 1873-8.

Pour l’administration des biens indivis, les partenaires peuvent conclure une convention relative à l’exercice de leurs droits indivis dans les conditions énoncées aux articles 1873-1 à 1873-15. A peine d’inopposabilité, cette convention est, à l’occasion de chaque acte d’acquisition d’un bien soumis à publicité foncière, publiée au fichier immobilier.

Par dérogation à l’article 1873-3, la convention d’indivision est réputée conclue pour la durée du pacte civil de solidarité. Toutefois, lors de la dissolution du pacte, les partenaires peuvent décider qu’elle continue de produire ses effets. Cette décision est soumise aux dispositions des articles 1873-1 à 1873-15.
