Article 519 of the French Code of Criminal Procedure

If the judgment is set aside because the court considers that the fact is of such a nature as to entail a criminal penalty, the court of appeal shall declare itself incompetent. It shall refer the Public Prosecutor’s Office back to appeal as it sees fit.

It may, after hearing the Public Prosecutor’s Office, issue a committal or arrest warrant against the accused by the same decision.

Si le jugement est annulé parce que la cour estime que le fait est de nature à entraîner une peine criminelle, la cour d’appel se déclare incompétente. Elle renvoie le ministère public à se pourvoir ainsi qu’il avisera.

Elle peut, le ministère public entendu, décerner par la même décision, mandat de dépôt ou d’arrêt contre le prévenu.
