Article 524 bis of the French General Tax Code

Exempt from the guarantee hallmark are:

a) Articles made before 1838 and those made after that date already bearing former French guarantee hallmarks;

b) Articles containing gold, silver or platinum and weighing less than thresholds set by decree;

c) Articles that cannot withstand the imprint of the hallmarks without deterioration;

d) Works brought into national territory from another Member State of the European Community or imported from another State party to the Agreement establishing the European Economic Area or from Turkey, already bearing the imprint, on the one hand, of a maker’s hallmark or a responsibility hallmark and, on the other hand, of a title hallmark registered in that State. The title hallmark must be affixed by an independent body or by the competent administration of the State concerned in accordance with standards identical or equivalent to those required in France for the control and certification of the title.

Article 524 bis

Sont dispensés du poinçon de garantie :

a) Les ouvrages antérieurs à l’année 1838 et ceux postérieurs à cette date déjà revêtus d’anciens poinçons français de garantie ;

b) Les ouvrages contenant de l’or, de l’argent ou du platine et d’un poids inférieur à des seuils fixés par décret ;

c) Les ouvrages qui ne peuvent supporter l’empreinte des poinçons sans détérioration ;

d) Les ouvrages introduits sur le territoire national en provenance d’un autre Etat membre de la Communauté européenne ou importés d’un autre Etat partie à l’accord instituant l’Espace économique européen ou de Turquie, comportant déjà l’empreinte, d’une part, d’un poinçon de fabricant ou d’un poinçon de responsabilité et, d’autre part, d’un poinçon de titre enregistrés dans cet Etat. Le poinçon de titre doit être apposé par un organisme indépendant ou par l’administration compétente de l’Etat concerné selon des normes identiques ou équivalentes à celles exigées en France pour le contrôle et la certification du titre.
