Article 545 of the French General Tax Code

Only goldsmiths, jewellers and jewellery manufacturers are authorised to manufacture gold, silver or platinum articles in any other non-legal capacity exclusively for shipment to other Member States of the European Community or for export to third countries.

Articles manufactured in this way may under no circumstances, on pain of seizure, be delivered for domestic consumption and they shall never bear the hallmarks of the guarantee. They must be marked, immediately after completion, with a master hallmark.

This is not the case unless the manufacturer files a declaration with the office of guarantee prior to putting these objects into manufacture (1), enters them in a special register as soon as they are completed and exports them or delivers them to another Member State of the European Union within a period set by decree in the Council of State (2).

Article 545

Les fabricants d’orfèvrerie, joaillerie, bijouterie sont seuls autorisés à fabriquer des objets d’or, d’argent ou de platine à tous autres titres non légaux exclusivement destinés à l’expédition vers les autres Etats membres de la Communauté européenne ou à l’exportation vers les pays tiers.

Les objets ainsi fabriqués ne peuvent, en aucun cas, sous peine de saisie, être livrés à la consommation intérieure et ils ne sont jamais revêtus des poinçons de la garantie. Ils doivent être marqués, aussitôt après l’achèvement, avec un poinçon de maître.

Il n’en est autrement que si le fabricant dépose au bureau de garantie une déclaration préalable de mise en fabrication de ces objets (1), les inscrit dès leur achèvement sur un registre spécial et les exporte ou les livre à destination d’un autre Etat membre de l’Union européenne dans un délai fixé par décret en Conseil d’Etat (2).
