Article 574-2 of the French Code of Criminal Procedure

The Criminal Division of the Court of Cassation hearing an appeal against a judgment referred to in Article 568-1 shall rule within forty days of the date of the appeal.

The applicant for judicial review or his lawyer must, on pain of forfeiture, file his statement of case setting out the grounds for judicial review within five days of receipt of the case file at the Cour de cassation. The submission of the pleading may be made by any means enabling a written record to be kept.

After the expiry of this period, no new plea may be raised by him and no further factum may be filed.

On receipt of the pleading, the President of the Criminal Division fixes the date of the hearing.

La chambre criminelle de la Cour de cassation saisie d’un pourvoi contre un arrêt visé à l’article 568-1 statue dans le délai de quarante jours à compter de la date du pourvoi.

Le demandeur en cassation ou son avocat doit, à peine de déchéance, déposer son mémoire exposant les moyens de cassation dans le délai de cinq jours à compter de la réception du dossier à la Cour de cassation. La transmission du mémoire peut être effectuée par tout moyen permettant d’en conserver une trace écrite.

Après l’expiration de ce délai, aucun moyen nouveau ne peut être soulevé par lui et il ne peut plus être déposé de mémoire.

Dès la réception du mémoire, le président de la chambre criminelle fixe la date de l’audience.
