Article 592 of the French Civil Code

In all other cases, the usufructuary may not touch the tall trees: he may only use, to make the repairs for which he is liable, trees uprooted or broken by accident; he may even, for this purpose, have them felled if necessary, but on condition that he establishes the need with the owner.

Dans tous les autres cas, l’usufruitier ne peut toucher aux arbres de haute futaie : il peut seulement employer, pour faire les réparations dont il est tenu, les arbres arrachés ou brisés par accident ; il peut même, pour cet objet, en faire abattre s’il est nécessaire, mais à la charge d’en faire constater la nécessité avec le propriétaire.
