Article 596 of the French Code of Criminal Procedure

In criminal cases and where the accused has been convicted, if the judgment has pronounced a penalty other than that applied by law to the nature of the crime, the annulment of the judgment may be pursued both by the public prosecutor and by the convicted party.

En matière criminelle et dans le cas où l’accusé a été condamné, si l’arrêt a prononcé une peine autre que celle appliquée par la loi à la nature du crime, l’annulation de l’arrêt pourra être poursuivie tant par le ministère public que par la partie condamnée.
