Any person in respect of whom there are one or more plausible grounds for suspecting that he has participated, as a perpetrator or accomplice, in the commission of a crime or offence punishable by imprisonment may request that a lawyer of his choice or, if he is unable to appoint one, a lawyer appointed ex officio by the President of the Bar:
1° Assist her when she takes part in an operation to reconstruct the offence;
2° Be present at a suspect identification session of which she is a part.
The person is informed of this right before these operations are carried out.
The appointed lawyer may, at the end of the operations, submit written observations which are attached to the proceedings. He may send these observations or a copy of them directly to the public prosecutor.
When the victim or complainant takes part in these operations, a lawyer may also assist him under the conditions provided for in article 61-2.
