Article 610 of the French Code of Criminal Procedure

In criminal matters, the Cour de cassation shall order the referral of the trial, namely:

– before an investigating chamber other than the one that handed down the indictment, if the quashed judgment emanates from an investigating chamber;

– before an assize court other than the one that handed down the judgment, if the judgment is quashed on the grounds of a nullity committed in the assize court ;

– before a court of appeal other than the one in whose jurisdiction the assize court that rendered the judgment sits, if the judgment is set aside only on the ground of civil interest.

Article 610

En matière criminelle, la Cour de cassation prononce le renvoi du procès, savoir :

– devant une chambre de l’instruction autre que celle qui a prononcé la mise en accusation, si l’arrêt annulé émane d’une chambre de l’instruction ;

– devant une cour d’assises autre que celle qui a rendu l’arrêt, si l’arrêt est annulé pour cause de nullité commise à la cour d’assises ;

– devant une cour d’appel autre que celle dans le ressort de laquelle siège la cour d’assises qui a rendu l’arrêt, si l’arrêt est annulé seulement du chef des intérêts civils.
