Article 614 of the French Code of Criminal Procedure

A copy of the judgment admitting the application for judicial review and ordering referral to a new court shall be delivered to the public prosecutor at the Cour de cassation within three days. This copy shall be sent, together with the record of the proceedings, to the magistrate responsible for the public prosecutor’s office at the referring court or tribunal.

The parties shall be notified of the judgment of the Cour de cassation, by that magistrate.

A copy shall also be sent by the public prosecutor at the Cour de cassation to the magistrate responsible for the public prosecutor’s office at the court or tribunal that delivered the judgment or ruling that was set aside.

Article 614

Une expédition de l’arrêt qui a admis la demande en cassation et ordonné le renvoi devant une nouvelle juridiction est délivrée au procureur général près la Cour de cassation dans les trois jours. Cette expédition est adressée, avec le dossier de la procédure, au magistrat chargé du ministère public près la cour ou le tribunal de renvoi.

L’arrêt de la Cour de cassation est notifié aux parties, à la diligence de ce magistrat.

Une expédition est également adressée par le procureur général près la Cour de cassation au magistrat chargé du ministère public près la cour ou le tribunal qui a rendu l’arrêt ou le jugement annulé.
