Article 617 of the French Code of civil procedure

The contrariety of judgments may be invoked when the plea of non-receivability based on the authority of res judicata has been unsuccessfully raised before the trial judges.

In this case, the appeal in cassation is directed against the judgment that is second in date; when the contrariety is established, it is resolved in favour of the first.

La contrariété de jugements peut être invoquée lorsque la fin de non-recevoir tirée de l’autorité de la chose jugée a en vain été opposée devant les juges du fond.

En ce cas, le pourvoi en cassation est dirigé contre le jugement second en date ; lorsque la contrariété est constatée, elle se résout au profit du premier.
