Article 620 of the French Code of civil procedure

The Cour de cassation may dismiss the appeal by substituting a ground of pure law for an erroneous ground; it may also do so by disregarding an erroneous but superabundant ground of law.

It may, unless otherwise provided, quash the contested decision by raising a ground of pure law of its own motion.

La Cour de cassation peut rejeter le pourvoi en substituant un motif de pur droit à un motif erroné ; elle le peut également en faisant abstraction d’un motif de droit erroné mais surabondant.

Elle peut, sauf disposition contraire, casser la décision attaquée en relevant d’office un moyen de pur droit.
