Article 621 of the French Code of Criminal Procedure

Where a court of appeal, assize court, criminal court or police court has handed down a final judgment or ruling which is subject to cassation and against which none of the parties has nevertheless lodged an appeal within the specified time limit, the public prosecutor at the Cour de cassation may, of his own motion and notwithstanding the expiry of the time limit, lodge an appeal against the said judgment or ruling, but solely in the interests of the law. The Court shall rule on the admissibility and merits of the appeal. If the appeal is allowed, the Supreme Court will declare the case null and void, without the parties being able to avail themselves of this and oppose the enforcement of the annulled decision.

Article 621

Lorsqu’il a été rendu par une cour d’appel ou d’assises ou par un tribunal correctionnel ou de police, un arrêt ou jugement en dernier ressort, sujet à cassation, et contre lequel néanmoins aucune des parties ne s’est pourvue dans le délai déterminé, le procureur général près la Cour de cassation peut d’office et nonobstant l’expiration du délai se pourvoir, mais dans le seul intérêt de la loi, contre ledit jugement ou arrêt. La Cour se prononce sur la recevabilité et le bien-fondé de ce pourvoi. Si le pourvoi est accueilli, la cassation est prononcée, sans que les parties puissent s’en prévaloir et s’opposer à l’exécution de la décision annulée.
