Article 624-3 of the French Code of Criminal Procedure

If the bench of the Court of Revision and Reconsideration considers that the case is not ready for hearing, it shall order that additional information be provided by one or more of its members for the purpose of carrying out, directly or by means of a letter rogatory, in the manner provided for in this Code, any act of information that may be useful in examining the application, with the exception of hearing any person in respect of whom there are reasonable grounds for suspecting that he has committed or attempted to commit an offence.

When the case is ready for hearing, the court’s bench examines the merits of the case and gives its decision, in a reasoned judgment that is not subject to appeal, after a public hearing during which the oral or written observations of the applicant or his lawyer, those of the public prosecutor and, if he intervenes in the proceedings, after having been duly notified, those of the civil party constituted in the trial whose review or re-examination is requested or his lawyer, are heard. The applicant or his lawyer shall have the last word.

The President of the Court may, in the course of the debates, request that the bench of judges hear any person who is relevant to the examination of the application.

Si la formation de jugement de la cour de révision et de réexamen estime que l’affaire n’est pas en l’état, elle ordonne l’exécution d’un supplément d’information confié à l’un ou à plusieurs de ses membres aux fins de procéder, directement ou par commission rogatoire, dans les formes prévues au présent code, à tout acte d’information utile à l’instruction de la demande, à l’exception de l’audition de toute personne à l’égard de laquelle il existe des raisons plausibles de soupçonner qu’elle a commis ou tenté de commettre une infraction.

Lorsque l’affaire est en état, la formation de jugement de la cour l’examine au fond et statue, par un arrêt motivé non susceptible de recours, à l’issue d’une audience publique au cours de laquelle sont recueillies les observations orales ou écrites du requérant ou de son avocat, celles du ministère public ainsi que, si elle intervient à l’instance, après en avoir été dûment avisée, celles de la partie civile constituée au procès dont la révision ou le réexamen est demandé ou de son avocat. Le requérant ou son avocat a la parole le dernier.

Le président de la cour peut, au cours des débats, demander l’audition par la formation de jugement de toute personne utile à l’examen de la demande.
