Where the International Criminal Court so requests, the enforcement of fines and confiscation sentences or decisions concerning reparations handed down by the International Criminal Court shall be authorised by the Criminal Court of Paris referred to it, for this purpose, by the Public Prosecutor. The procedure followed before the criminal court is governed by the rules of this code.
The court is bound by the decision of the International Criminal Court, including the provisions relating to the rights of third parties. However, in the case of enforcement of a confiscation order, it may order all measures designed to enable the value of the proceeds, property or assets of which the court has ordered confiscation to be recovered, where it appears that the confiscation order cannot be enforced. The court hears the convicted person and any person with rights to the property, if necessary by means of a rogatory commission. These persons may be represented by a lawyer.
Where the court finds that enforcement of a confiscation or reparation order would have the effect of harming a bona fide third party who cannot appeal against the said order, it shall inform the public prosecutor with a view to referring the matter to the International Criminal Court, which shall take all appropriate action.
