Article 627-19 of the French Code of Criminal Procedure

Upon arrival in France, the transferred person is presented to the public prosecutor of the place of arrival, who will question the person and draw up a report. However, if the examination cannot be carried out immediately, the person is taken to the prison where he or she may not be held for more than twenty-four hours. On expiry of this period, he or she will be brought before the public prosecutor by the head of the prison.

In the light of the documents recording the agreement between the French Government and the International Criminal Court concerning the transfer of the person concerned, a certified copy of the sentencing judgement and notification by the court of the date on which the sentence will begin to be served and the time remaining to be served, the public prosecutor will order the immediate incarceration of the convicted person.

Dès son arrivée sur le territoire de la République, la personne transférée est présentée au procureur de la République du lieu d’arrivée, qui procède à son interrogatoire d’identité et en dresse procès-verbal. Toutefois, si l’interrogatoire ne peut être immédiatement effectué, la personne est conduite à la maison d’arrêt où elle ne peut être détenue plus de vingt-quatre heures. A l’expiration de ce délai, elle est conduite d’office devant le procureur de la République par les soins du chef d’établissement.

Au vu des pièces constatant l’accord entre le Gouvernement français et la Cour pénale internationale concernant le transfert de l’intéressé, d’une copie certifiée conforme du jugement de condamnation et d’une notification par la cour de la date de début d’exécution de la peine et de la durée restant à accomplir, le procureur de la République ordonne l’incarcération immédiate de la personne condamnée.
