For the prosecution, investigation and trial of offences falling within the scope of article 628, the anti-terrorist public prosecutor, the investigating judge and the Paris assize court exercise concurrent jurisdiction with that resulting from the application of articles 43 et 52.
As regards minors, the anti-terrorist public prosecutor, the investigating judge, the juvenile court and the Paris juvenile assize court exercise concurrent jurisdiction with that resulting from the application of Order no. 45-174 of 2 February 1945 relating to delinquent children.
Where they have jurisdiction to prosecute and investigate offences falling within the scope of Article 628, the anti-terrorist public prosecutor and the investigating judge in Paris exercise their powers throughout France.
By way of derogation from Article 34, the Public Prosecutor’s Office at the Assize Court ruling at first instance is represented, when exercising its jurisdiction for the prosecution of offences falling within the scope of Article 628, by the Anti-Terrorism Public Prosecutor in person or by his or her deputies. On appeal, the Public Prosecutor may be represented by the Anti-Terrorism Public Prosecutor or one of his deputies.
By way of derogation from the second paragraph of Article 380-1, in the event of an appeal against a judgment of the Paris Assize Court with jurisdiction pursuant to this Article, the First President of the Paris Court of Appeal or the Criminal Division of the Court of Cassation may designate that same Assize Court, otherwise composed, to hear the appeal.
