The public prosecutor at a judicial court other than that of Paris may, for offences falling within the scope of Article 628, request the investigating judge to relinquish jurisdiction in favour of the Paris investigating court. The parties shall be notified in advance and invited to make their observations by the investigating judge; the order shall be made eight days at the earliest and one month at the latest from the date of such notification.
The order by which the investigating judge relinquishes jurisdiction shall not take effect until the five-day period provided for in Article 628-6 has elapsed; where an appeal is lodged pursuant to that same Article, the investigating judge shall remain seised until the judgment of the Criminal Division of the Court of Cassation has been brought to his attention.
As soon as the order has become final, the public prosecutor sends the case file to the anti-terrorist public prosecutor.
