Article 628-3 of the French Code of Criminal Procedure

When it appears to the investigating judge in Paris that the acts referred to him do not constitute one of the offences falling within the scope of Article 628 and do not fall within its jurisdiction in any other respect, this magistrate declares that he has no jurisdiction either at the request of the Anti-Terrorism Public Prosecutor or, after receiving the latter’s opinion, of his own motion or at the request of the parties. Any parties who have not submitted an application shall be notified in advance and invited to make their observations known; the order shall be made at the earliest eight days after this notification.

The second paragraph of Article 628-2 shall apply to the order by which the Paris investigating judge declares that he does not have jurisdiction.

As soon as the order has become final, the anti-terrorist public prosecutor shall send the case file to the public prosecutor with territorial jurisdiction.

This article shall apply when the investigating chamber of the Paris court of appeal rules on its jurisdiction.

Lorsqu’il apparaît au juge d’instruction de Paris que les faits dont il a été saisi ne constituent pas une des infractions entrant dans le champ d’application de l’article 628 et ne relèvent pas de sa compétence à un autre titre, ce magistrat se déclare incompétent soit sur requête du procureur de la République antiterroriste, soit, après avis de ce dernier, d’office ou sur requête des parties. Celles des parties qui n’ont pas présenté une requête sont préalablement avisées et invitées à faire connaître leurs observations ; l’ordonnance est rendue au plus tôt huit jours après cet avis.

Le deuxième alinéa de l’article 628-2 est applicable à l’ordonnance par laquelle le juge d’instruction de Paris se déclare incompétent.

Dès que l’ordonnance est devenue définitive, le procureur de la République antiterroriste adresse le dossier de la procédure au procureur de la République territorialement compétent.

Le présent article est applicable lorsque la chambre de l’instruction de la cour d’appel de Paris statue sur sa compétence.
