Article 63-8 of the French Code of Criminal Procedure

At the end of police custody, the person is, on the instructions of the public prosecutor under whose supervision the investigation is being conducted, either released or brought before that magistrate.

If the person is released at the end of police custody without any decision having been taken by the public prosecutor on the public prosecution, the provisions of Article 77-2 shall be brought to the person’s attention.

A l’issue de la garde à vue, la personne est, sur instruction du procureur de la République sous la direction duquel l’enquête est menée, soit remise en liberté, soit déférée devant ce magistrat.


Si la personne est remise en liberté à l’issue de la garde à vue sans qu’aucune décision n’ait été prise par le procureur de la République sur l’action publique, les dispositions de l’article 77-2 sont portées à sa connaissance.
