Article 63-9 of the French Code of Criminal Procedure

The public prosecutor responsible for being notified of police custody, monitoring its progress, ordering its extension and deciding on the outcome of the measure is the one under whose direction the investigation is being conducted.

However, the public prosecutor of the place where the police custody is being carried out also has the power to monitor and order its extension.

Le procureur de la République compétent pour être avisé des placements en garde à vue, en contrôler le déroulement, en ordonner la prolongation et décider de l’issue de la mesure est celui sous la direction duquel l’enquête est menée.


Toutefois, le procureur de la République du lieu où est exécutée la garde à vue est également compétent pour la contrôler et en ordonner la prolongation.
