If the act committed during the hearing of a correctional tribunal or court is a misdemeanour, it may be proceeded with as stated in the previous article. In this case, if the sentence pronounced is more than one month’s imprisonment, a committal order may be issued.
If the act, qualified as a misdemeanour, has been committed at a police court hearing, the president shall draw up a report, which he shall forward to the public prosecutor; he may, if the penalty incurred is more than six months’ imprisonment, order the arrest of the perpetrator, and his immediate bringing before the public prosecutor.
Notwithstanding the foregoing provisions, where the offence of contempt provided for by article 434-24 of the Penal Code, the presiding judge shall draw up a report, which he shall forward to the public prosecutor. Magistrates who took part in the hearing when the offence was committed may not sit on the court hearing the prosecution.
