If a request for mutual assistance from a foreign judicial authority concerns acts committed outside national territory that are likely to be connected with the missions carried out, for the purposes of defending and promoting the fundamental interests of the Nation provided for in article L. 811-3 of the Internal Security Code, by a specialised intelligence service provided for in article L. 811-2 of the same code, the public prosecutor to whom this request has been made, or who has been notified pursuant to article 694-1 of this Code, forwards it to the Public Prosecutor who refers it to the Minister of Justice, and informs, where appropriate, the investigating judge of this referral.
The Minister of Justice informs the Minister responsible for the specialist intelligence service concerned and obtains his opinion.
Within a period of one month, the latter shall inform the Minister of Justice whether execution of the request for mutual assistance is likely to undermine the fundamental interests of the Nation.
The Minister of Justice shall, where appropriate, inform the requesting authority that its request cannot be complied with, in whole or in part. This decision shall be notified to the judicial authority initially seized and shall prevent the execution of the request for mutual assistance or the return of enforcement documents.
