Article 694-48 of the French Code of Criminal Procedure

Where the issuing State requests, under a European Investigation Order, the hearing of a person by means of audiovisual communication in accordance with the procedures laid down in Article 706-71, the judge hearing the case may, without prejudice to the provisions of Article 694-31, refuse to execute the request if it concerns the hearing of a suspected or accused person and if that person objects.

In the case of the examination of a witness, the provisions of this Code governing the refusal to give evidence or to take an oath, and those of Articles 434-13,434-14 and 434-15-1 of the Penal Code punishing perjury are applicable.

Lorsque l’Etat d’émission sollicite, au titre d’une décision d’enquête européenne, l’audition d’une personne par un moyen de communication audiovisuelle selon les modalités prévues par l’article 706-71, le magistrat saisi peut, sans préjudice des dispositions de l’article 694-31, refuser l’exécution de la demande s’il s’agit de l’audition d’une personne suspecte ou poursuivie et si celle-ci s’y oppose.


S’il s’agit de l’audition d’un témoin, les dispositions du présent code réprimant le refus de déposer ou de prêter serment, et celles des articles 434-13,434-14 et 434-15-1 du code pénal réprimant le faux témoignage sont applicables.
