The second to last paragraphs of Article 695-23 shall not apply to the surrender procedures mentioned in this section.
By way of derogation from the first paragraph of the same Article 695-23, the surrender of a person shall be carried out without verification of the dual criminality of the acts complained of when the acts in question are, under the law of the non-EU Member State, punishable by a custodial sentence of at least twelve months’ imprisonment or by a custodial security measure of a similar duration and fall within one of the following categories of offence:
1° Participation in a group of persons acting with a common purpose to commit one or more offences falling within the scope of terrorist activities referred to in Articles 1 and 2 of the European Convention on the Suppression of Terrorism, signed in Strasbourg on 27 January 1977, and in Articles 1 to 4 of the Framework Decision of 13 June 2002 on combating terrorism (2002/475/JHA) ;
2° Illicit trafficking in narcotic drugs or psychotropic substances;
3° Manslaughter;
4° Aggravated assault;
5° Kidnapping, illegal restraint or hostage-taking;
6° Rape.
