I. – The national member may, as a national authority with the authorisation of the competent judicial authority, submit requests or take decisions in matters of judicial cooperation in application, in particular, of instruments based on the principle of mutual recognition.
As soon as the act referred to in the authorisation has been carried out, the national member shall inform that authority and send it the implementing documents, in original or copy depending on the decision of that authority.
II. – The national member may propose to the public prosecutor or the public prosecutor that the following acts be performed or request that they be performed:
1° Acts necessary for the execution of requests made or decisions taken in matters of judicial cooperation by another Member State pursuant, in particular, to instruments based on the principle of mutual recognition;
2° Investigative acts which have been considered, following a coordination meeting organised by the Eurojust Agency, to be necessary for the effectiveness of investigations conducted on the territory of several Member States;
3° Operations to monitor the routing or transport of objects, goods or proceeds derived from the commission of one or more offences or used to commit them.
The representative of the Public Prosecutor’s Office shall inform the national member as soon as possible of the action he intends to take on his proposal.
