Article 695-9-2 of the French Code of Criminal Procedure

A freezing order may be issued in respect of any movable or immovable property, whether tangible or intangible, and any legal instrument or document evidencing title to or interest in such property, which the judicial authority of the issuing State considers to be the proceeds of an offence or to correspond in whole or in part to the value of such proceeds, or to be the instrument or object of an offence.

The provisions of this Section shall not apply to requests to prevent the destruction, transformation, moving, transfer or disposal of an object, document or data, which may serve as evidence, even if it is the proceeds of an offence or constitutes the instrument or object of an offence, such requests to be the subject of a European Investigation Order in accordance with the provisions of Section 1 of this Chapter.

Article 695-9-2

Peut faire l’objet d’une décision de gel tout bien meuble ou immeuble, corporel ou incorporel, ainsi que tout acte juridique ou document attestant d’un titre ou d’un droit sur ce bien, dont l’autorité judiciaire de l’Etat d’émission estime qu’il est le produit d’une infraction ou correspond en tout ou partie à la valeur de ce produit, ou constitue l’instrument ou l’objet d’une infraction.

Les dispositions de la présente section ne sont pas applicables aux demandes tendant à empêcher la destruction, la transformation, le déplacement, le transfert ou l’aliénation d’un objet, document ou donnée, susceptible de servir de pièce à conviction, même s’il s’agit du produit d’une infraction ou qu’il constitue l’instrument ou l’objet d’une infraction, ces demandes devant faire l’objet d’une décision d’enquête européenne conformément aux dispositions de la section 1 du présent chapitre.
