Article 695-9-27 of the French Code of Criminal Procedure

Where the request has been made with a view to the subsequent confiscation of the property, it shall be retained on French territory in accordance with the rules of this Code.

If the investigating judge, in application of these rules, considers not to retain the property, he shall notify the judicial authority of the issuing State and give it an opportunity to comment before taking his decision.

Lorsque la demande a été émise en vue de la confiscation ultérieure du bien, celui-ci est conservé sur le territoire français selon les règles du présent code.

Si le juge d’instruction, en application de ces règles, envisage de ne pas conserver le bien, il en avise l’autorité judiciaire de l’Etat d’émission et la met à même de produire ses observations avant de prendre sa décision.
