Article 695 of the French Civil Code

The title constituting the servitude, in respect of those which cannot be acquired by prescription, can only be replaced by a title recognising the servitude, and emanating from the owner of the servient land.

Le titre constitutif de la servitude, à l’égard de celles qui ne peuvent s’acquérir par la prescription, ne peut être remplacé que par un titre récognitif de la servitude, et émané du propriétaire du fonds asservi.
