Where, in the cases mentioned in Article 25(6) of the aforementioned Council Regulation (EU) 2017/1939 of 12 October 2017, the investigating judge hearing the information refuses to relinquish jurisdiction in favour of the European Public Prosecutor’s Office, he shall invite the parties to make their observations known within a period of five days.
At the end of this period, the investigating judge shall issue an order refusing to relinquish jurisdiction, which shall be notified to the public prosecutor and the parties.
Within five days of its notification, this order may be referred, at the request of the European Public Prosecutor’s Office, the public prosecutor or the parties, to the criminal chamber of the Cour de cassation.
The criminal chamber of the Cour de cassation shall designate, within eight days of the date of receipt of the case file, the magistrate competent to continue the investigations. The European Public Prosecutor’s Office, the investigating judge and the Public Prosecutor’s Office are notified of the Criminal Division’s ruling and the parties are notified. The examining magistrate remains seized of the case until he is notified of the judgment.
The European Public Prosecutor, the examining magistrate and the Public Prosecutor are notified of the judgment of the Criminal Division.
