In the event that the requesting government seeks, for an offence prior to extradition, authorisation to prosecute or enforce a sentence concerning the person already surrendered, the opinion of the investigating chamber before which the person claimed had appeared may be formulated solely on the basis of the documents transmitted in support of the new request.
The documents containing the observations of the person surrendered or the declaration that he intends to submit none shall also be transmitted by the foreign government and submitted to the investigating chamber. These explanations may be supplemented by a lawyer chosen by him, or who is appointed or court-appointed.
Where the person claimed declares that he consents to the extension of his extradition, the procedure laid down in section 3 of this chapter shall apply.
