Article 696-35 of the French Code of Criminal Procedure

In the event that the requesting government seeks, for an offence prior to extradition, authorisation to prosecute or enforce a sentence concerning the person already surrendered, the opinion of the investigating chamber before which the person claimed had appeared may be formulated solely on the basis of the documents transmitted in support of the new request.

The documents containing the observations of the person surrendered or the declaration that he intends to submit none shall also be transmitted by the foreign government and submitted to the investigating chamber. These explanations may be supplemented by a lawyer chosen by him, or who is appointed or court-appointed.

Where the person claimed declares that he consents to the extension of his extradition, the procedure laid down in section 3 of this chapter shall apply.

Dans le cas où le gouvernement requérant demande, pour une infraction antérieure à l’extradition, l’autorisation de poursuivre ou de mettre à exécution une condamnation concernant l’individu déjà remis, l’avis de la chambre de l’instruction devant laquelle la personne réclamée avait comparu peut être formulé sur la seule production des pièces transmises à l’appui de la nouvelle demande.

Sont également transmises par le gouvernement étranger et soumises à la chambre de l’instruction les pièces contenant les observations de l’individu remis ou la déclaration qu’il entend n’en présenter aucune. Ces explications peuvent être complétées par un avocat choisi par lui, ou qui est désigné ou commis d’office.

Lorsque la personne réclamée déclare consentir à l’extension de son extradition, la procédure prévue à la section 3 du présent chapitre est applicable.
