Article 696-41 of the French Code of Criminal Procedure

In the event that, the extradition of a foreigner having been obtained by the French Government, the Government of a third country in turn requests the French Government to extradite the same individual on account of an act prior to the extradition, other than that tried in France, and not connected with that act, the Government shall, if necessary, accede to such request only after having ascertained the consent of the country by which the extradition was granted.

However, this reservation need not be applied where the person extradited has had, during the period fixed in Article 696-39, the opportunity to leave French territory.

Article 696-41

Dans le cas où, l’extradition d’un étranger ayant été obtenue par le gouvernement français, le gouvernement d’un pays tiers sollicite à son tour du gouvernement français l’extradition du même individu à raison d’un fait antérieur à l’extradition, autre que celui jugé en France, et non connexe à ce fait, le Gouvernement ne défère, s’il y a lieu, à cette requête qu’après s’être assuré du consentement du pays par lequel l’extradition a été accordée.

Toutefois, cette réserve n’a pas lieu d’être appliquée lorsque l’individu extradé a eu, pendant le délai fixé à l’article 696-39, la faculté de quitter le territoire français.
