Article 696-67 of the French Code of Criminal Procedure

The competent public prosecutor is the one in whose jurisdiction the habitual and lawful residence of the person placed under judicial supervision is located or the one where the person requests to reside. Failing this, the public prosecutor at the Paris judicial court has jurisdiction.

If the public prosecutor to whom the request has been addressed by the issuing State does not have jurisdiction, he will forward it without delay to the competent public prosecutor. The competent authority of the issuing State shall be informed of the transmission.

Le procureur de la République compétent est celui dans le ressort duquel se situe la résidence habituelle et régulière de la personne placée sous contrôle judiciaire ou celle où la personne demande à résider. A défaut, le procureur de la République près le tribunal judiciaire de Paris est compétent.

Si le procureur de la République auquel la demande a été adressée par l’Etat d’émission n’est pas compétent, il la transmet sans délai au procureur de la République compétent. L’autorité compétente de l’Etat d’émission est informée de la transmission.
