Article 700 of the French General Tax Code

During the period when operations remain provisionally under the legal quarrying regime, pursuant to article L. 312-4 or the second paragraph of article L. 312-11 of the French Mining Code concerning the transfer to the class of mines of substances previously subject to the legal quarrying regime, exchanges of ownership rights or exploitation rights relating to quarries of substances newly made concessible by decree benefit, with the exception of balancing payments or capital gains, an exemption from all duties in favour of the State, provided that the exchange is authorised in advance by a decree issued with the assent of the Conseil d’Etat and countersigned by the Minister for the Economy and Finance and the Minister for Mines, and that the exchange deed expressly refers to the authorising decree. The latter must state that the exchange is being carried out with a view to rationalising the exploitation of the deposits and increasing their productivity.

Article 700

Pendant la période où des exploitations restent provisoirement sous le régime légal des carrières, en application de l’article L. 312-4 ou du second alinéa de l’article L. 312-11 du code minier concernant le passage dans la classe des mines de substances antérieurement soumises au régime légal des carrières, les échanges de droits de propriété ou de droits d’exploitation portant sur des carrières de substances nouvellement rendues concessibles par décret, bénéficient, sauf en ce qui concerne les soultes ou plus-values, d’une exonération de tous droits au profit de l’Etat, à condition, d’une part, que l’échange soit préalablement autorisé par un décret rendu sur avis conforme du conseil d’Etat et contresigné par le ministre de l’économie et des finances et par le ministre chargé des mines et, d’autre part, que l’acte d’échange se réfère expressément au décret d’autorisation. Ce dernier devra constater que l’échange est effectué en vue de rationaliser l’exploitation des gisements et d’accroître leur productivité.
