Any person who, as the victim of theft, fraud, breach of trust, extortion or the destruction, damage or deterioration of property belonging to him or her, is unable to obtain effective and adequate reparation or compensation for his or her loss on any grounds whatsoever, and as a result finds himself in a serious material or psychological situation, may obtain compensation under the conditions set out in Articles 706-3 (3° and last paragraph) to 706-12, when his resources are below the ceiling set by l’article 4 de la loi n° 91-647 du 10 juillet 1991 relative à l’aide juridique to benefit from partial legal aid, taking into account, where applicable, their family responsibilities.
The allowance is at most equal to three times the monthly amount of this resource ceiling.
These provisions also apply to the persons mentioned in Article 706-3 who, as victims of an offence against the person provided for by this article, are not entitled to full reparation for their loss, as the events giving rise to the loss have resulted in a total incapacity to work of less than one month.
