If it is not necessary to maintain the seizure of the property in due form, a creditor with an enforceable title establishing a liquid and payable claim may be authorised, under the conditions provided for in Article 706-144, to initiate or resume civil enforcement proceedings against the property, in accordance with the rules applicable to such proceedings. However, the property may not then be sold out of court and the seizure may be carried over to the balance of the sale price, after payment of creditors holding a security ranking prior to the date on which the seizure became enforceable. The balance of the proceeds of the sale is consigned. If the case is dismissed, the case is not pursued or the accused is acquitted, or if the penalty of confiscation is not imposed, these proceeds are returned to the owner of the property if he or she so requests.
In the event of the resumption of civil enforcement proceedings suspended by the criminal seizure, the formalities that were duly completed do not have to be repeated.
