Where the seizure relates to a claim for a sum of money, the third party debtor must immediately deposit the sum due with the Caisse des dépôts et consignations or with the Agence de gestion et de recouvrement des avoirs saisis et confisqués (Agency for the Management and Recovery of Seized and Confiscated Assets) where the latter has been seized. However, in the case of conditional or term debts, the funds are deposited when these debts become due.
Where the seizure relates to a claim under a life insurance policy, it will result in the suspension of the options to surrender, renounce or pledge the policy, pending the final judgment on the merits. The seizure also prohibits any subsequent acceptance of the benefits of the contract pending this judgment, and the insurer may no longer make advances to the policyholder. The seizure is notified to the policyholder and to the insurer or organisation from which the policy was taken out.
