Without prejudice to the provisions of articles 706-81 to 706-87 of this code, and for the sole purpose of recording the offences of acquiring, offering or transferring narcotics referred to in articles 222-37 and 222-39 of the Penal Code, to identify the perpetrators and accomplices and to carry out the seizures provided for in this Code, officers of the judicial police and, under their authority, judicial police officers may, with the authorisation of the public prosecutor or investigating judge hearing the case, who shall give prior notice to the public prosecutor, and without being criminally liable for these acts :
1° Acquire narcotic products;
2° With a view to acquiring narcotic products, make legal or financial means available to persons engaging in these offences, as well as means of transport, deposit, accommodation, storage and telecommunications.
On pain of nullity, the authorisation of the public prosecutor or investigating judge, which may be given by any means, shall be mentioned or placed in the record of the proceedings and the acts authorised may not constitute incitement to commit an offence.
