Article 706-40 of the French Code of Criminal Procedure

In the event of an offence under 3° of article 225-10 of the Penal Code, the occupier and the person engaging in prostitution are jointly and severally liable for any damages that may be awarded for neighbourhood disturbance. Where the acts referred to in this article are practised on a regular basis, the lease may be terminated and the tenant, sub-tenant or occupant who engages in or tolerates prostitution may be evicted by the interim relief judge, at the request of the public prosecutor, the owner, the main tenant or the occupants or neighbours of the building. The owners or lessors of these premises are informed, at the request of the public prosecutor, that they are being used as places of prostitution.

En cas d’infraction prévue par le 3° de l’article 225-10 du code pénal, l’occupant et la personne se livrant à la prostitution sont solidairement responsables des dommages-intérêts pouvant être alloués pour trouble du voisinage. Lorsque les faits visés par cet article sont pratiqués de façon habituelle, la résiliation du bail et l’expulsion du locataire, sous-locataire ou occupant qui se livre à la prostitution ou la tolère sont prononcées par le juge des référés, à la demande du ministère public, du propriétaire, du locataire principal ou des occupants ou voisins de l’immeuble. Les propriétaires ou bailleurs de ces locaux sont informés, à la diligence du ministère public, que ceux-ci servent de lieux de prostitution.
