The claim for compensation, accompanied by supporting documents, is forwarded without delay by the registry of the compensation commission to the guarantee fund for victims of acts of terrorism and other offences.
The latter is required, within two months of receipt, to make an offer of compensation to the victim. Reasons must be given for any refusal of an offer of compensation by the guarantee fund. These provisions also apply in the event of a worsening of the injury.
If the victim accepts the offer of compensation, the guarantee fund forwards the statement of agreement to the president of the compensation commission for homologation.
In the event of a reasoned refusal by the guarantee fund, or the victim’s disagreement with the offer made to him or her, the case continues to be investigated by the chairman of the commission or the assessor magistrate.
When the loss is not in a state to be liquidated and the guarantee fund does not contest the right to compensation, it may, at any stage of the procedure, pay an advance to the victim. The guarantee fund shall keep the president of the compensation commission immediately informed.
The detailed rules for the application of this article shall be laid down by decree in the Conseil d’Etat.
