On pain of foreclosure, the claim for compensation must be made within three years of the date of the offence. Where criminal proceedings are brought, this time limit is extended and does not expire until one year after the court has given a final ruling on the public prosecution or on the civil action brought before the criminal court. However, the Commission shall relieve the claimant of the foreclosure when the information provided for in Article 706-15 has not been given, when the claimant has not been able to assert his rights within the required timeframe or when he has suffered an aggravation of his prejudice or for any other legitimate reason.
Where a decision of a criminal court has awarded damages to the victim and the claim is deemed inadmissible, the time limit provided for in the second paragraph of Article 706-15-2 only runs from notification of the commission’s decision.
