Article 706-7 of the French Code of Criminal Procedure

Where criminal proceedings have been instituted, the commission’s decision may be taken before a ruling has been made on the public prosecution.

The commission may, for the application of the last paragraph of Article 706-3, stay the proceedings until a final decision has been taken by the criminal court. In all cases, it must stay the proceedings at the request of the victim.

The hearings take place and the decision is given in chambers.

Lorsque des poursuites pénales ont été engagées, la décision de la commission peut intervenir avant qu’il ait été statué sur l’action publique.

La commission peut, pour l’application du dernier alinéa de l’article 706-3, surseoir à statuer jusqu’à décision définitive de la juridiction répressive. Dans tous les cas, elle doit surseoir à statuer à la demande de la victime.

Les débats ont lieu et la décision est rendue en chambre du conseil.
