Article 706-72-4 of the French Code of Criminal Procedure

When the Criminal Court or the Paris Juvenile Court declares that it does not have jurisdiction on the grounds set out in Article 706-72-3, it shall refer the Public Prosecutor’s Office to take action as it sees fit; it may, after hearing the Public Prosecutor’s Office, issue, by the same decision, a committal or arrest warrant for the accused.

Lorsque le tribunal correctionnel ou le tribunal pour enfants de Paris se déclare incompétent pour les motifs prévus à l’article 706-72-3, il renvoie le ministère public à se pourvoir ainsi qu’il avisera ; il peut, le ministère public entendu, décerner, par la même décision, mandat de dépôt ou d’arrêt contre le prévenu.
