Any order made on the basis of articles 706-72-2 or 706-72-3 by which an examining magistrate decides to relinquish jurisdiction or by which the examining magistrate of the Paris Judicial Court decides to decline jurisdiction may, to the exclusion of all other means of appeal, be referred within five days of its notification, at the request of the public prosecutor or one of the parties, to the Criminal Division of the Court of Cassation which shall designate, within eight days of the date of receipt of the file, the court responsible for continuing the investigation. The Public Prosecutor may also refer the matter directly to the Criminal Division of the Court of Cassation if the investigating judge has not made an order within the one-month period provided for in the first paragraph of Article 706-72-2.
The Criminal Division that finds that the investigating judge of the Paris Judicial Court does not have jurisdiction may nevertheless, in the interests of the proper administration of justice, decide that the investigation will be continued in that court.
The investigating judge and the public prosecutor shall be notified of the judgment of the Criminal Division and the parties shall be served.
This article shall apply to a judgment given on the basis of the last paragraph of Articles 706-72-2 and 706-72-3 in which an investigating chamber rules on its relinquishment or jurisdiction.
