Article 724 of the French General Tax Code

I. – Treaties or agreements having as their object the transfer for valuable consideration of an office are subject to a registration duty determined in accordance with the tariff provided for in Article 719 (1). Registration duty is levied on the price expressed in the deed of transfer and the capital of any charges that may be added to the price.

II. – In the event of the creation of new offices or the appointment of new holders without presentation, as a result of removal or for any other reason, if the new holders are required to pay a sum determined for the value of the office, duty is payable on this compensation at the rate fixed in I.

The duty must be paid before the new holder is sworn in.

III. – In the event of the abolition of an office title, where, in the absence of a treaty, the decree pronouncing the abolition fixes an indemnity to be paid to the holder of the abolished office or to his heirs, a copy of this decree must be registered within one month of its issue.

The duty is levied on the amount of the compensation, at the rate set out in I.

Article 724

I. – Les traités ou conventions ayant pour objet la transmission à titre onéreux d’un office sont soumis à un droit d’enregistrement déterminé selon le tarif prévu à l’article 719 (1). Le droit d’enregistrement est perçu sur le prix exprimé dans l’acte de cession et le capital des charges qui peuvent ajouter au prix.

II. – En cas de création de nouvelles charges ou de nomination de nouveaux titulaires sans présentation, par suite de destitution ou pour tout autre motif, s’il est imposé aux nouveaux titulaires le paiement d’une somme déterminée pour la valeur de l’office, le droit est exigible sur cette indemnité au tarif fixé au I.

Le droit doit être acquitté avant la prestation de serment du nouveau titulaire.

III. – En cas de suppression d’un titre d’office, lorsqu’à défaut de traité, le décret qui prononce l’extinction fixe une indemnité à payer au titulaire de l’office supprimé ou à ses héritiers, l’expédition de ce décret doit être enregistrée dans le mois de la délivrance.

Le droit est perçu sur le montant de l’indemnité, au tarif fixé au I.
