Article 74-1 of the French Code of Criminal Procedure

When the disappearance of a minor or a protected adult of full age has just occurred or has been noted, officers of the judicial police or, under their supervision, judicial police officers may, on the instructions of the public prosecutor, carry out the acts provided for in the articles 56 to 62, for the purpose of discovering the missing person. At the end of a period of eight days from the instructions of this magistrate, these investigations may continue in the form of a preliminary enquiry.

The Public Prosecutor may also request that an investigation be opened into the causes of the disappearance.

The provisions of this article also apply in the event of the disappearance of a person of full age who is of a worrying or suspicious nature given the circumstances, the age of the person concerned or their state of health.

Article 74-1

Lorsque la disparition d’un mineur ou d’un majeur protégé vient d’intervenir ou d’être constatée, les officiers de police judiciaire ou, sous leur contrôle, les agents de police judiciaire peuvent, sur instructions du procureur de la République, procéder aux actes prévus par les articles 56 à 62, aux fins de découvrir la personne disparue. A l’issue d’un délai de huit jours à compter des instructions de ce magistrat, ces investigations peuvent se poursuivre dans les formes de l’enquête préliminaire.

Le procureur de la République peut également requérir l’ouverture d’une information pour recherche des causes de la disparition.

Les dispositions du présent article sont également applicables en cas de disparition d’un majeur présentant un caractère inquiétant ou suspect eu égard aux circonstances, à l’âge de l’intéressé ou à son état de santé.
