Article 77 of the French Code of civil procedure

In non-contentious matters, the court may note of its own motion that it does not have territorial jurisdiction. In contentious matters, he may do so only in disputes relating to the status of persons, in cases where the law assigns exclusive jurisdiction to another court or if the defendant fails to appear.

En matière gracieuse, le juge peut relever d’office son incompétence territoriale. Il ne le peut, en matière contentieuse, que dans les litiges relatifs à l’état des personnes, dans les cas où la loi attribue compétence exclusive à une autre juridiction ou si le défendeur ne comparaît pas.
