Article 78-2-4 of the French Code of Criminal Procedure

I.-To prevent a serious threat to the safety of persons and property, officers of the judicial police and, on their orders and under their responsibility, the judicial police officers and deputy judicial police officers mentioned in 1°, 1° bis and 1° ter of Article 21 may carry out not only the identity checks provided for in the eighth paragraph of article 78-2 but also, with the agreement of the driver or owner of the luggage or, failing that, on instructions from the public prosecutor communicated by any means, to :

1° Inspecting vehicles travelling, stopped or parked on the public highway or in places accessible to the public;

2° Visually inspecting luggage or searching it.

II.-For the application of 1° of I of this article, II of article 78-2-2 shall apply.

Pending instructions from the public prosecutor, the vehicle may be immobilised for a period not exceeding thirty minutes.

III.-For the application of 2° of I of this article, III of article 78-2-2 is applicable.

Pending instructions from the public prosecutor, the owner of the baggage may be detained for a period that may not exceed thirty minutes.

Article 78-2-4

I.-Pour prévenir une atteinte grave à la sécurité des personnes et des biens, les officiers de police judiciaire et, sur l’ordre et sous la responsabilité de ceux-ci, les agents de police judiciaire et les agents de police judiciaire adjoints mentionnés aux 1°, 1° bis et 1° ter de l’article 21 peuvent procéder non seulement aux contrôles d’identité prévus au huitième alinéa de l’article 78-2 mais aussi, avec l’accord du conducteur ou du propriétaire du bagage ou, à défaut, sur instructions du procureur de la République communiquées par tous moyens, à :

1° La visite des véhicules circulant, arrêtés ou stationnant sur la voie publique ou dans des lieux accessibles au public ;

2° L’inspection visuelle des bagages ou leur fouille.

II.-Pour l’application du 1° du I du présent article, le II de l’article 78-2-2 est applicable.

Dans l’attente des instructions du procureur de la République, le véhicule peut être immobilisé pour une durée qui ne peut excéder trente minutes.

III.-Pour l’application du 2° du I du présent article, le III de l’article 78-2-2 est applicable.

Dans l’attente des instructions du procureur de la République, le propriétaire du bagage peut être retenu pour une durée qui ne peut excéder trente minutes.
